Downloadable eBook End-User License Agreement

If you have not purchased a legitimate digital or hard copy of the respective downloadable eBook (each an “eBook”) from the authorized web shop located at www.russiangost.com (the “Web Shop”) you have no rights under this Downloadable eBook End-User License Agreement (the “License”) and must either remove the respective eBook from your computer and/or devices or purchase a legitimate copy from the Web Shop.

Please read this License carefully before accessing or using the eBook.  DO NOT CLICK ON THE BUTTON THAT INDICATES THAT YOU ACCEPT THIS LICENSE, OR USE THIS EBOOK UNTIL YOU HAVE READ AND AGREED TO BE BOUND BY THIS LICENSE. You are agreeing to the terms and conditions set out in this License if you click on the accept button (in which case the download, ftp transfer, email, cloud access, or installation (collectively “Install”) of the eBook will continue), or in any other way use, access, copy, or install this eBook. If you do not accept these terms and conditions, click on the button that indicates that you do not accept this License and the Installation of the eBook will stop.  In addition, by accessing or using the eBook, you are agreeing to be bound by the terms of this License.  If you do not agree to the terms of this License, you must discontinue use of and access to the eBook.

1) License
The respective eBook and included text, maps, graphics, figures, illustrations, and other content, and all materials, including, but not limited to images, designs, icons, logos, photographs, video clips, audio clips, trademarks, tradenames, and service marks that are part of the Web Shop (collectively referred to herein as the “Content”) are licensed to you by RGTT LLC., the United States of America, State of Texas corporation (the “Licensor”).  The licenses granted herein are limited to the Licensor’s intellectual property rights in the Content and do not include any other patents or intellectual property rights. You own the media to which you have installed the Content, but the Licensor retains all rights, title and interest in and to the Content, including all copyrights and ownership rights. The eBook and the Content and any copies that this License authorizes you to make are subject to all the terms, conditions, provisions, and restrictions contained in this License.

2) Copyright
The Content is the property of the Licensor and is protected by the copyright laws of the United States and worldwide by various copyright and intellectual property laws and treaties.  You do not acquire ownership rights to any of the Content through the use of or access to the respective eBook. You agree to abide by any and all additional copyright notices, information, or restrictions associated with the Content.  By accessing or using the Content in any way, you acknowledge the validity and enforceability of the intellectual property rights owned by the Licensor and embodied in the Content and agree that you will not in any way infringe, either directly or indirectly, the Licensor’s intellectual property rights in or to the Content.

3) Permitted Uses and Restrictions
This License allows you to install and use the Content on TWO (2) personal computer(s) and up to TWO (2) personal electronic devices used by you, members of your immediate family living at the same address, or co-workers employed by the same entity in the same location / facility. If you wish to install the Content on three (3) or more computers, please purchase the Multiple-User License at the www.russiangost.com Store or by contacting the Licensor directly. Personal electronic devices must have a screen of twelve (12) or fewer inches diagonal measure.  This License does not allow the Content to exist on more than TWO (2) personal computer(s) and TWO (2) personal electronic devices at a time. Any new user on an additional personal computer or personal electronic device shall be required to accept this License.
You agree that you are only authorized to access or use the Content for your own personal use (or in cases when it is purchased for your business, for your business use ), and that you shall not duplicate, download, publish, modify or otherwise distribute any material accessed through the Web Shop for any purpose other than for such personal or business use, unless otherwise specifically authorized in writing by the Licensor.  No Content accessed via the Web Shop may be copied, reproduced, framed, hyperlinked, republished, downloaded, uploaded, posted, transmitted, licensed, modified, or distributed in any way.  The reproduction, duplication, distribution (including by way of email, facsimile, or other electronic means), publication, modification, copying or transmission of Content accessed via the Web Shop is STRICTLY PROHIBITED unless you have obtained the prior written consent of Licensor.  No other distribution of the Content including, but not limited to, distribution via site licensing, on-line distribution, off-line downloading, tapes, discs, CD-ROM, optical media, hard copy formats, or print publication shall be permitted without the express written permission of an authorized officer of Licensor. 
You may not utilize any automated computer program or activity to search, index, test, download, or grab information from the Content (including but not limited to web robots, spiders, and crawlers). Licensor reserves the right, in its sole discretion, to block or otherwise prevent the unauthorized use of such programs or activities.
You specifically agree and understand that no rights of dissemination by any third party and no rights to sub-license to any third party are being granted to you under this License.
Except for the limited rights and licenses specifically provided herein, this License shall not transfer to you any right, title, or interest in or to the Content, or in any data included in the Content or the Web Shop, or in any copyright or trademark pertaining thereto. You acknowledge that you have no claim to ownership of any Content on the Web Shop simply by reason of your use of or access to the Web Shop.

4) Accounts
If you register as a user of the Web Shop and/or purchaser of an eBook, you will be assigned a username and password that is unique to you. You are responsible for maintaining the confidentiality of the username and password, and are fully responsible for all activities that occur under your username and password, whether or not authorized by you.  By accessing the Web Shop, you represent and warrant that: (i) you are the customer who registered for the Web Shop and related Content; (ii) that you are using the Web Shop and the Content only for permitted purposes; (iii) you will immediately notify Licensor of any unauthorized use of the password or account or any other breach of security; and (iv) you will ensure that you exit from your account at the end of each session. Please notify Licensor at customer service of any potential unauthorized use(s) of your account or breach of security.

5) Availability; Software Not Included
While Licensor will make all reasonable efforts to ensure that access to the eBooks and the Web Shop are available at all times, Licensor does not guarantee, represent, or warrant that your access to the Web Shop or the eBooks will be uninterrupted or error-free.  In addition, while Licensor makes reasonable efforts to ensure that all information submitted by you to Licensor will be secure, Licensor does not guarantee that Web Shop and access to the eBooks will be free from loss, corruption, attack, viruses, “worms”, “trojan horses” or other harmful components, or from interference, hacking or other security intrusions.  Licensor may also impose limits on the use of or access to certain features or portions of the Web Shop, in any case without notice or liability.
The Content is provided in standard electronic publishing formats, including Portable Document Format (PDF), ePUB, and Kindle/MobiPocket.  Software to view content in these formats is available on most computing platforms, either as part of the device firmware or as downloads from the Internet.  Users must have an internet connection.

6) Limited Warranty; Limitation of Liability
The Licensor warrants only that the downloaded file will be readable on the platform(s) stated on the Web Shop, using recommended reader software current at the time of download.  This limited warranty, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to ninety (90) days from the date of original download.  The limited warranty set forth herein is exclusive and in lieu of all others, whether oral or written, express or implied.  The Licensor specifically disclaims all other warranties.
Under no circumstances, including negligence, shall the Licensor be liable for any incidental, special, indirect, or consequential damages arising out of or relating to this License.  In no event shall the Licensor’s total liability to you for all damages exceed the amount paid by you through the Web Shop.

7) Term; Termination
By using the Web Shop and using or accessing the Content, you understand and agree that if Licensor determines, in its sole discretion, that you have breached any of the terms and conditions of this License, your conduct is disruptive, or you have violated the law or the rights of Licensor or another user, Licensor reserves the right to suspend or terminate access to the Web Shop and to any Content offered via the Web Shop and take any other action which Licensor, in its sole discretion, deems to be appropriate.
This License is effective until terminated by Licensor.  Licensor may terminate this License with respect to you or any other third party without notice at any time for any reason.  All terms that by their nature should survive termination of this License will survive.

8) Compliance with Laws; Controlling Law and Severability
You agree to comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Web Shop or the Content. Licensor may, in its sole discretion, report actual or perceived violations of law to law enforcement or appropriate authorities.  If Licensor becomes aware, through a complaint or otherwise, of any potential or suspected violation of this License, it may (but is not obligated to) conduct an investigation to determine the nature and extent of the suspected violation and the appropriate enforcement action, during which investigation Licensor may suspend services to any user being investigated and/or remove any material from its servers.  You agree to cooperate fully with any such investigation. You acknowledge that violations of the terms and conditions of this License could be subject to criminal or civil penalties.
This License shall be governed by the laws of the United States and the State of Texas.  If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.

9) Digital Millennium Copyright Act Policy
If you are notifying Licensor of alleged copyright infringement, please be sure to provide the following information in the form required by 17 U.S.C. § 512:
1. A description of the copyrighted work that you allege is being infringed, or, if multiple copyrighted covered by a single notification, a representative list of such works;
2. A description of the allegedly infringing material and information sufficient to permit us to locate the material;
3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and/or an electronic mail address;
4. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, or its agent, or the law; and
5. A statement by you that the information in the notification is accurate and that you have the authority to enforce the copyrights that are claimed to be infringed.

10) Complete Agreement
This License constitutes the entire agreement between the parties with respect to the use of the Content licensed hereunder and supersedes all prior or contemporaneous understandings regarding such subject matter.  No amendment to or modification of this License will be binding unless in writing from the Licensor.
